CDC is conducting the analysis and the enforcement of competition law damage claims Europe-wide. Most of our activities concern cases following infringement decisions of the European Commission or national competition authorities. Our cases are among the largest of their kind in Europe.

On 19 July 2016 the European Commission announced that it had fined manufacturers of medium and heavy duty trucks over EUR 2.93 billion for their participation in a price fixing cartel covering the entire European Economic Area and lasting 14 years from 1997 to 2011 (Case COMP/39824 – Trucks). It found the following companies to have participated in the cartel giving rise to competition law damages claims.

Paraffin Wax Cartel

Paraffin Wax Cartel

In 2011 CDC filed in the Netherlands a legal action enforcing claims for damages resulting from the Europe-wide Paraffin Wax cartel. Previously, CDC had acquired the claims from numerous purchasers of paraffin wax. Paraffin wax is mainly used for candle production, but has also a wide range of applications in packaging, cosmetics, construction and food industry. The paraffin wax case is one of many CDC competition law damage claims.

Sodium Chlorate Cartel

CDC filed in May 2011 an action against four members of the Europe-wide sodium chlorate cartel in the Netherlands. Sodium chlorate is a bleaching agent mainly used in the pulp and paper industry.

Hydrogen Peroxide Cartel

Hydrogen Peroxide Cartel

Our first damage case which resulted in landmark judgments and significant settlements relate to the Europe-wide Hydrogen Peroxide cartel. Hydrogen Peroxide is a bleaching agent which is mainly used by the pulp and paper industry. CDC launched damage actions in 2009 in Germany and in 2011 in Finland.

Cement Cartels

Cement Cartels

CDC is known for its activities with regard to the German cement cartel case. Competition law damage claims were subsequently launched in 2005 before the Regional Court of Düsseldorf, Germany, and in 2015 before the Regional Court of Mannheim, Germany. The actions concern damage claims sold and assigned by companies damaged by the cement cartel.
